INTRODUCTION

Welcome to vivify-me operated under HEED Inc. ("Company," "we," "us," "our"). We are a registered company in Calgary, Alberta, Canada.

We operate the websites www.vivify-me.com and www.resultstherapy.ca (the "Site") and provide hypno-coaching, hypnotherapy, educational content, and other related services (collectively, the "Services").

By accessing the vivify-me or Results Therapy websites, blogs, learning portals, or participating in any program, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.  If you do not agree, you must discontinue use immediately.

1. SERVICES OFFERED

1.1. Hypno-Coaching & Hypnotherapy Services

• Hypno-coaching services are provided through webinars, online or in-person sessions, and multimedia content.

   
  

• All sessions are conducted virtually or in-person.

   
  

1.2. Website & Learning Portal

• The website offers free and paid resources, including articles, videos, and hypnosis-related content.

   
  

• The learning portal provides structured programs, session content, and guided exercises.

   
  

2. MEMBERSHIP & PROGRAM FEES

• Program Fee is as shown on the vivify-me program website (one-time payment). 

   
  

• Hypnotherapy Session Fees: as shown on the Results Therapy website.

   
  

• The fee includes online coaching sessions, digital resources, and email support.

   
  

• Payment Processing: via Elevon Credit Card Services

   
  

• No Insurance Coverage: We do not accept insurance or employer-provided medical plans.

   
  

• No Refund Policy: All payments are final. No refunds or chargebacks will be processed.

   
  

3. USER COMMITMENTS

3.1. Commitment to the Program

By becoming a Client of vivify-me, you agree to:

• Fully participate in lessons and assignments.

   
  

• Accept that results are not guaranteed and depend on your effort and openness.

   
  

• Maintain professional and respectful conduct.

   
  

3.2. Standards of Behavior

You agree to:

• Attend sessions free from drugs and alcohol (except prescribed medication).

   
  

• Treat company representatives with respect and professionalism.

   
  

• Arrive on time for sessions. Late arrivals may result in a shorter session without fee adjustments.

   
  

• Understand that therapy results may vary and are not guaranteed.

   
  

4. WEBSITE TERMS OF USE

4.1. Blog & Learning Portal

• Content on the vivify-me blog and learning portal is for informational and educational purposes only.

   
  

• Users may not republish, copy, distribute, or commercially exploit materials without written permission.

   
  

• We are not responsible for third-party links or external content referenced on the website.

   
  

4.2. User Registration

• You may be required to create an account to access certain Services.

   
  

• You must keep login credentials confidential and notify us of any unauthorized use.

   
  

• We reserve the right to suspend or terminate accounts violating our Terms.

   
  

4.3. User Contributions & Testimonials

• If you provide a testimonial, review, or comment, you grant us permission to use, edit, and share it for marketing purposes.

7. REFUNDS & CANCELLATION POLICIES

• No refunds on vivify-me program fee, coaching and hypnotherapy sessions..

   
  

• Session rescheduling is allowed with 24 hours' notice, otherwise there will be no refund for the booked session.

   
  

• Subscription-based services in the learning portal can be cancelled any time before the next billing cycle.

   
  

8. SOCIAL MEDIA & COMMUNITY GUIDELINES

• Users may not post hate speech, spam, misleading information, or illegal content.

   
  

• We reserve the right to remove any content and suspend accounts for violations.

   
  

9. LIABILITY DISCLAIMERS & USER RESPONSIBILITY

• AI-generated recommendations from chatbots or learning tools are for informational purposes only and should not replace professional advice.

   
  

10. TERMINATION OF SERVICES

• We reserve the right to terminate access for users who violate terms, abuse services, or engage in unlawful behavior.

   
  

• Termination is at our discretion and does not entitle users to refunds.

   
  

11. INTELLECTUAL PROPERTY & NON-TRANSFERABILITY

• Memberships, course access, and materials cannot be transferred, resold, or shared.

   
  

• All intellectual property rights remain with vivify-me and HEED Inc.

   
  

12. GOVERNING LAW & DISPUTE RESOLUTION

• These Terms are governed by the laws of Canada.

   
  

• Any disputes shall be resolved through mediation or arbitration in Alberta.

   
  

• Users waive the right to participate in class-action lawsuits.

PARTICIPANT ACKNOWLEDGEMENTS & CONSENTS

By using our Services, you acknowledge that:

• You have no medical or psychological conditions that prohibit hypnosis.

   
  

• You understand that hypnosis and coaching do not guarantee results.

   
  

• You release Vivify-Me™ and HEED Inc. from all legal claims related to your participation.

   
  

I acknowledge that hypnosis is a method of voluntarily inducing a pleasant state of relaxed concentration, during which the conscious mind is relaxed and relatively inactive, and the subconscious mind is more receptive.

I acknowledge that hypnosis as well as coaching, is a collaborative and cooperative process. I understand and agree that results from the Services depend in part on my participation, and I assume full responsibility for my actions or inactions that relate to any Services.

I acknowledge that no one can be hypnotized against their will, and accordingly that I must be a willing hypnosis subject. I further acknowledge and agree that under hypnosis I cannot be made to do anything I am not willing to do, and that a hypnosis subject must be willing and cooperative for hypnosis to work. I accept full responsibility for the consequences of my receipt of, and participation in, the Services.

I understand that, while hypnosis is a tool for positive change, unknown individual risks and circumstances can arise from my receipt of the Services that cannot be foreseen and that can influence or reduce results. Accordingly, I recognize that I could experience negative reactions from the Services, and accordingly, I accept any and all risks for any adverse reactions that I may have.

I acknowledge and agree that hypnosis as offered by the Company is not a medical treatment, but a process whereby an individual is taught to use his or her abilities for his or her own benefit.

I acknowledge and agree that hypnosis is not, and is not a replacement for, medical treatment, psychological or psychiatric treatments, or counselling.

I acknowledge and agree that Vivify-Me and/or hypnosis does not treat, prescribe for, or diagnose any condition, and that Vivify-Me™ strongly recommends that I inform my doctors and therapists of my use of coaching and hypnosis.

I understand that the Practitioner is a facilitator of hypnosis and is not practicing any profession that requires a license under the laws of the Province of Alberta, Canada.

By using the Services, I hereby fully and completely hold harmless, indemnify and release the Company and each of the Company Persons, and anyone otherwise affiliated with the Company’s business, from any and all causes of action, allegations, suits, claims, damages, or demands whatsoever, in law or equity, that may arise in the past, present or future that is in any way related to the Services.

I acknowledge and represent that I have read and understand its terms, and I knowingly and voluntarily execute it under my own free will, without relying on any other oral or written statement or representation of the company. I am aware I may be waiving certain legal rights, including the right to sue.
